Conditions of Sale
(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 as amended and supplemented)
1. PREMISE AND EFFECTIVENESS OF THE GENERAL CONDITIONS
The purpose of these general conditions of sale (hereinafter, "General Conditions") is to regulate the purchase of products and services, made at a distance and made available, via the Internet, by the coffeetrainingacademy.com website (hereinafter, the "Site") in compliance with the Italian regulations set forth in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, "Consumer Code").
The seller of the products and owner of the Site is: Davide Cobelli with registered office in Via Basso Acquar 30/C 37135, Verona (ITALY) C.F/ P.I. n. 04153650231- E-mail address: segreteria@coffeetrainingacademy.com (hereinafter, "CTA").
The consumer who accesses the Site to make purchases (hereinafter "Customer") is required, before sending the order, to read carefully these General Conditions that have been made available to him on the Site and that will be available at all times by the Customer also through the link contained in the confirmation email of each order to allow him to reproduce and store them.
In the event that the person making purchases on the Site requires the issuance of an invoice and/or is otherwise not a "consumer or user" as defined in art. 3, paragraph 1, letter a), of the Consumer Code, the regulations on withdrawal in art. 7 and 8 of these General Conditions or, more generally, the provisions that under the same Consumer Code apply only to "consumers" will not apply.
Contracts concluded with CTA through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian or English. The language can be changed by the user using the appropriate link affixed on the main pages of the Site.
2. CHOOSING AND ORDERING PRODUCTS
The characteristics and price of the various products for sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each Product.
In order to purchase the Products, the Customer shall complete and submit the order form in electronic format, following the instructions contained in the Site. The Customer shall add the Product to the "Shopping Cart" and, after having read the General Conditions and Privacy Policy and confirmed their acceptance, shall enter the shipping and possible billing information, select the desired payment method and confirm the order.
By submitting the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase process and fully accepts these transcribed General Terms and Conditions and Payment Policy. CTA's receipt of the contract proposal is confirmed by a summary email.
Following confirmation of receipt of the contract proposal, the customer has 2 hours to vary the submitted order by giving immediate notice to the email address: segreteria@coffeetrainingacademy.com. Once the 2 hours have passed, the order will no longer be modifiable by the customer.
Once the order is received, CTA will check stock availability to fulfill the order. In the event that one or more Products are not available, CTA Customer Service will promptly notify the Customer via email who, within the next 12 hours, will have the option to respond to confirm the shipment of any additional available Products or cancel it. If no response is received within that time, the order will be considered confirmed and the available Products will be placed for shipment. In this case, the full amount related to the missing Products will be reversed or otherwise, depending on the payment method chosen, will not be charged to the Customer.
The contract entered into between CTA and the Customer shall be deemed concluded with the acceptance of the order by CTA Such acceptance is communicated to the Customer through an email confirming shipment of the order containing a reference to these General Conditions, the order number, shipping and billing information, the list of Products ordered with their essential characteristics and the total price, including delivery charges.
Other emails, sent before the shipment of the products, shall not be considered as acceptance, implicit or explicit, of the order.
3. PRODUCT INFORMATION
Information and features relating to the Products are available on the Site.
The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves is for the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ, for example, in color and size. In case of difference between the image and the written product sheet, the description of the product sheet shall always prevail.
4. PRICES AND SHIPPING
Product prices are inclusive of all taxes and duties. All prices are quoted in Euros.
The currently applied indicative rates may change at any time.
In case of discrepancies between the shipping costs shown on the above page and the shipping costs calculated on the site during checkout, the latter shall always prevail. No refund will be due by CTA to the customer in case the rates calculated during checkout are higher
5. PAYMENT AND BILLING METHODS
5.1 PAYMENT METHODS.
The Customer may make payment of the price of the Products and related delivery charges by Credit Card or PayPal.
CREDIT CARD
The circuits on which it is possible to purchase within the Site are:
- Visa / Visa Electron
- Mastercard / Maestro
- AMEX
To ensure maximum security, the transaction will be made on the site of the financial operator processing the payment (payment gateway).
The Site does not store the Customer's credit card number and therefore cannot be held responsible for any fraudulent use of the above payment instruments.
PAYPAL
Once the order has been confirmed, the Customer will be redirected to PayPal's site where he/she can make payment with his/her account or using a card, including prepaid cards, or otherwise in the manner accepted by PayPal and in accordance with its terms.
5.2 INVOICING OF ORDERS
If the purchase is made by a professional, it will be possible to request the issuance of an invoice by sending the billing information including tax code and/or VAT number to segreteria@coffeetrainingacademy.com. In this case, the invoice will be sent via email to the indicated address. The professional is responsible for the correct entry of the billing data and is expressly informed that if the invoice is not requested when ordering, it will not be possible to request it later.
